Teen arrested after shots are fired near Overfelt High School in San Jose

San Jose police arrested a 16-year-old suspect after someone fired a handgun at a car and hit an occupied house near Overfelt High School, shortly after school on Thursday afternoon.

No injuries were reported, but the apparent target — a white compact car with four or five occupants — drove away, Officer Enrique Garcia said. Police do not know if the car was hit.

However, several rounds penetrated a house on Cunningham Avenue, near Winterpark Way, Garcia said. He called the incident gang-related.

School let out at 3:15 p.m., and the shots were reported about 15 minutes later, Garcia said. The gunman was on foot and the car was traveling on Cunningham, police said. After interviewing witnesses and school officials, police arrested the 16-year-old male. His identity was withheld because he is a minor.

Principal Vito Chiala said the suspect had been a student at Overfelt for only one day this year, and had not attended school on Thursday. "We were trying to find a better placement for him,'' Chiala said.

The youth was booked into juvenile hall on charges of possession of a firearm within 1,000 feet of a school, shooting into an inhabited dwelling, possession of ammunition and violation of probation. He had been on probation for vandalism, auto theft, carrying a concealed weapon and assault and battery committed against a school employee.
